ACCEPTANCE OF A BUYER’S ORDER IS CONDITIONED UPON THE ACCEPTANCE OF THESE TERMS & CONDITIONS.
VARIATIONS IN GOODS. Due to the nature of Feizy’s goods, Buyer understands that sizes, color and texture may vary slightly and there may be some minor design inconsistencies.
INVOICED BUYERS. Invoices must be paid in full within the terms as indicated on the invoice. Past due amounts are subject to an interest rate at the lesser of: (1) 18% per annum; or (2) the maximum rate permitted by law.
INSPECTION ON ARRIVAL. Buyer must inspect goods in the presence of the carrier before accepting the goods. Any shortage/damage must be clearly marked on the Carrier’s delivery receipt at time of delivery. If buyer accepts the goods as is, buyer is responsible for payment to Feizy, despite any damage or shortage caused by carrier. Feizy is not responsible for goods damaged/shorted in transit unless noted at the time of delivery. Buyer is to notify Feizy immediately of any delivery exceptions that were noted on Carrier’s delivery receipt. When notated correctly, Feizy will work with the carrier and customer to get the item(s) replaced/located.
TAX ON PURCHASES. A valid sales tax exemption certificate, or resale certificate, is needed in order to make tax-free purchases with Feizy. As such, Buyer must provide Feizy with a properly completed certificate prior to purchase or Feizy will calculate the sale with the appropriate and applicable taxes.
RETURN WINDOW. If Buyer is not happy with Feizy’s goods for any reason, Buyer may return the goods in undamaged new condition for a refund within thirty (30) calendar days of purchase. Feizy may reduce, or reject, a refund for goods returned damaged which were not the result of Feizy’s actions or which were not defective at the time sold.
BEFORE RETURNING GOODS. Prior to returning any goods, Buyer must contact Feizy’s Customer Service at [email protected] for a Return Merchandise Authorization Number (RMA #). The RMA # must accompany all returned goods. Feizy shall refuse to accept any returned goods which fail to adhere to the return policy instructions or which lack an RMA #. Buyer must return the goods within 15 days of obtaining this RMA#.
SHIPPING COSTS. Buyer shall be required to return the goods at their own expense and Buyer must provide tracking number and proof of delivery upon Feizy’s request. However, if Buyer is returning defective goods or goods which were shipped to them incorrectly, Feizy will issue a call tag and Feizy will be responsible for the cost to return.
REFUNDS. 6-8 weeks to process and mail any refund checks and 1 week to appear on credit card statement.
DISCONTINUED GOODS: Discontinued goods are sold “AS IS” and may not be returned for any reason.
ALL OTHER GOODS: All goods which are not discontinued goods are sold with the following limited warranties:
CHOICE OF FORUM AND CHOICE OF LAW. Any disputes concerning Feizy’s goods shall be submitted for resolution exclusively to the courts in Dallas Texas. This Agreement shall be exclusively governed by and construed in accordance with the laws of the State of Texas.
FORCE MAJEURE. In the event that Feizy shall be prevented from performing any of its obligations due to an act of God, or other event beyond the control of Feizy, Feizy shall be excused from performance of the obligation.
SALES/USE TAX. Sales to U.S. vendors are subject to sales tax unless vendors provide Feizy with a resale certificate prior to the sales transaction.
ATTORNEY FEES. Feizy may recover all reasonable costs incurred in collecting any delinquency on a Feizy account, including collection agency fees, attorney’s fees and any and all other costs associated with the collection of the delinquent account.
**These Terms & Conditions may be modified from time to time by Feizy without notice; or if modifications are proposed by Buyer, these Terms & Conditions may only be modified by written agreement, signed by Feizy.
